The use of AI across creative industries has been a subject of intense debate in recent years, with outrage such as the [Hollywood protests in 2023](https://apnews.com/article/artificial-intelligence-hollywood-strikes-explained-writers-actors-e872bd63ab52c3ea9f7d6e825240a202) about AI use in the industry. Gaming holds its own special place in this discussion because of its heavy basis in coding and technology, along with the human aspect of storytelling and design. Will video game development fall victim to an AI takeover? 

# How AI is Changing Game Development

Many developers are experimenting with how AI can be used to create more interactive and personalized stories within the game, as well as augmenting in-game dialogue and narratives. 

[BBC spoke about this subject](https://www.bbc.com/news/business-68844761) with Andrew Maximov, founder of Promethean AI, who explained that "he believes that artificial intelligence (AI) will play a crucial role in keeping the soaring costs of game production down, and save video game designers vital time by automating repetitive tasks." He sees AI as a creativity-enabler for artists. Maximov also told BBC that he hopes AI will allow for adaptive gameplay, with it determining what happens next based on the user's actions. 

Ultimately, he thinks that AI will shift the purpose of jobs in the industry, moving people from doing repetitive tasks like coding maps and landscapes to designing narratives and "rich backstories, memories, knowledge, and goals," which all need thoughtful human input. 

# AI's Creative Limits

An [article published by CNET](https://www.cnet.com/tech/gaming/generative-ai-is-coming-for-video-games-heres-how-it-could-change-gaming/) discussed an experiment run by Keywords Studios, a technical and creative solutions provider for the video game industry. The experiment, called [Project AVA](https://www.keywordsstudios.com/en/ava-at-gdc/), involved integrating around 400 AI tools into their game development. Keywords Studios presented their findings at the Game Developers Conference (GDC) 2024. 

The team concluded several things from the study. Overall, they found that, although the AI-generated art was up to standards in terms of static images, it was relatively poor at creating user interfaces, including layouts, menus, and icons. They also found that AI was pretty unsuccessful at debugging, sometimes even worsening the problems. 

The conclusion from Keywords Studios? Although AI was useful as a tool for game development, it was just that: a tool. "Ultimately, every step required human curation, since periodic tool updates broke their prompts," CNET reported. 

 

# Ethics & Hidden Risks

So what could this mean for future developers? Is AI coming to replace human creativity? Or is it going to be a tool to enhance it? 

CNET touches on this subject in their article, referencing a GDC AI round table discussion led by Neil Kirby, a senior lecturer at Ohio State University's College of Engineering. The discussion highlighted how AI is affecting students and the next generation of coders.  

"The upside is the potential for uninterrupted flow as students use the tool to suggest solutions to roadblocks rather than have to break concentration to look up answers -- a version of the tried-and-tested pair programming concept for coders. " He noted however, that young coders should not use AI as a shortcut or replacement for understanding core disciplines of core programming, as this would leave them unprepared and uninformed. 

The CNET article also discusses ethical dilemmas in the context of Hidden Door, a game developer that uses generative AI and public domain books to create interactive worlds for users. Because of concerns over AI bias, "Hidden Door's models are trained on data the company creates or synthesizes itself. Rather than ingesting tons of written works, it creates new works on the fly weighing different words and concepts according to the genre, " CNET wrote.  

This raises questions in the industry about how large language models, which are trained on relatively uncurated public data sets, will be used for video game developers, especially when they will have to "compete with the people who created the original data."

In the European Union, ethical data collection is governed by strict regulations designed to protect individuals' privacy and ensure transparency. Businesses operating within the EU, even ones headquartered outside the bloc, are obligated to follow clear ethical procedures in order to avoid penalties. 

This guide covers the essential info companies need to know about ethical EU data collection: how it is defined, the procedures, and considerations for businesses based outside the EU. 

## How the EU Defines Ethical Data Collection 

The cornerstone of EU data collection regulations is the [General Data Protection Regulation](https://gdpr.eu/data-privacy/) (GDPR) – the toughest privacy and security law in the world. This EU legal framework sets out clear guidelines for how businesses and organizations operating in the EU can ethically collect, store, and process personal data. 

GDPR went into effect in May 2018 and was the bloc’s first major data privacy and security law. It imposes legally-binding ethical data obligations onto any organization that collects EU citizen data, no matter where it is based in the world. 

To be considered ethical under GDPR regulations, data collection has to always be lawful, fair, and transparent. This means organizations must inform individuals about what data is being collected, why it is being collected, and how it will be used. This communication needs to happen at the moment you collect personal data from a user, not after the fact. Additionally, data collection should be limited to what is necessary. Gathering excessive or irrelevant information violates GDPR regulations. 

Non-compliance with GDPR rules can be extremely expensive. Fines can reach up to €20 million, or 4% of the firm's worldwide annual revenue from the preceding financial year, whichever is greater. In April 2023, [Meta](https://www.edpb.europa.eu/news/news/2023/12-billion-euro-fine-facebook-result-edpb-binding-decision_en) was issued the largest-ever GDPR penalty – a €1.2 billion fine for improperly transferring personal data to the U.S. 

### Data Hoarding vs. Data Collecting 

While _data collection_ is essential for businesses and research, data hoarding is a growing problem for companies and organizations. Data hoarding is concerning because it creates security and privacy risks and can impact a company’s operations. 

But what is data hoarding? Unlike ethical data collection, which gathers relevant and necessary data with a clear purpose, data hoarding involves collecting excessive amounts of data without a defined use case. Holding on to large amounts of data with no purpose can lead to security vulnerabilities, inefficient data management, and potential regulatory violations. 

Ethical data collection follows the principle of data minimization – the practice of ensuring only necessary information is collected and stored for a limited period. Organizations should conduct regular audits to eliminate outdated or unnecessary data and avoid the risks associated with data hoarding. 

### Is Data Hoarding Illegal? 

Whether or not data hoarding is legal depends on an organization’s compliance with data protection laws. Under GDPR, organizations have to justify the reason they collect and process data. Holding onto excessive, unused data without a valid legal basis can violate GDPR [data processing principles](https://gdpr.eu/article-5-how-to-process-personal-data/), leading to hefty fines and reputational damage. 

The more data a company stores, the more data it has to protect as well. Organizations that fail to sufficiently secure data are at risk of being breached. That can result in legal and financial consequences too. Ethical data collection procedures help businesses avoid these risks while maintaining compliance and trust with their customers. 

## Ethical Data Collection Procedures 

Following correct procedures for ethical data collection ensures compliance with EU regulations and makes consumers more likely to share their data.  

Here are key steps organizations should take: 

1. **Obtain Informed Consent**: Before collecting personal data, businesses must clearly inform individuals about what data is being gathered, how it will be used, and their rights regarding their information. Consent must be freely given, be specific, and be revocable at any time. 
 
2. **Follow Data Minimization Practices**: Only collect data necessary for your organization’s intended purpose. This reduces risks associated with data breaches and regulatory non-compliance. 
 
3. **Ensure Transparency and Accountability**: Businesses should provide clear privacy policies and allow users to access, modify, or delete their data upon request. EU regulations specify the right to erasure, also known as “[the right to be forgotten](https://gdpr.eu/right-to-be-forgotten/).” This allows an individual to request to have their data deleted so that it can no longer be found by third parties, such as search engines.  
 
4. **Secure Data Storage and Processing**: Encrypting sensitive information and implementing strong access controls helps protect collected data from unauthorized access and cyber threats. 
 
5. **Regularly Audit and Update Data Management Practices**: Organizations should regularly review their data collection practices to ensure compliance and remove outdated or unnecessary information.

## Considerations for Businesses Based Outside of the EU 

Many businesses operating outside the EU still need to comply with GDPR and ethical data collection principles. If your company collects data from EU citizens, it has to adhere to the same strict regulations as EU-based organizations. 

Key Considerations: 

- **Appoint a Data Protection Officer (DPO)**: Companies handling large amounts of EU citizen data may be required to appoint a DPO to oversee compliance. 
 
- **Implement GDPR Compliance Measures**: Ensure your company uses consent mechanisms, security protocols, and data management strategies that align with EU regulations.

"The enormous amount of unstructured data in healthcare, which is typically underutilized, presents a targeted and transformative opportunity for meaningful technological innovation." 

Startups like [Bioptimus](https://www.bioptimus.com/about) are taking advantage of this already, stating that their mission is "to build the first universal AI foundation model for biology to fuel breakthrough discoveries and accelerate innovations in biomedicine and beyond." Bioptimus recently announced the [release of H-optimus-0](https://www.bioptimus.com/news/bioptimus-launches-h-optimus-0-the-worlds-largest-open-source-ai-foundation-model-for-pathology),” the world’s largest open-source AI foundation model for pathology." This model can perform critical diagnostic tasks such as identifying cancerous cells or genetic abnormalities in a tumor. 

With data being one of the most vital resources, it underscores the need for technology professionals like data scientists in the healthcare industry, and potentially in hospitals in general. # Europe Takes the Lead
